In the past six months, Mark Semeraro and Scott Fahrney have had great success in the Appellate Division relative to Redevelopment law and Land Use.
On December 21, 2017, Scott Fahrney and Mark Semeraro, on the behalf of the City of Union City, we prevailed in defending a Prerogative Writ challenge to a Redevelopment Plan in the matter of Larry Price vs. The City of Union City, A-5294-15T4.
On February 13, 2018, Scott Fahrney and Mark Semeraro again prevailed in defending another Prerogative Writ challenge to the City’s declaration of an area needing redevelopment in the matter of Larry Price vs. City of Union City and Sky Pointe, LLC, A-0285-16T4.
On May 10, 2018, Mark Semeraro prevailed in a Prerogative Writ challenge to the City of Bayonne’s Planning Board’s preliminary and final approval to construct a mixed-use building consisting of 91 residential units and ground for commercial use in the matter of Martin, et al vs. City of Bayonne, City of Bayonne Planning Board and 975 Broadway Owner, LLC, A-1564-16T1.
Additionally, Mark Semeraro also was successful in defending the City of Union City’s challenges to 3 separate decisions of the City of Union City’s Rent Leveling Board in decisions rendered on May 3 and May 9 of 2018 in the matters of S&L Realty Corp of New Jersey vs. Rent Leveling Board of City of Union City and 2715 Central Realty LLC vs. City of Union City Rent Leveling Board and Nilda Jimenez, respectively. In all three matters, the City’s actions were withheld in Court.
