BLUE COLLAR, CONSTRUCTION SITE, WORKPLACE HARRASSMENT OVER PERCEIVED SEXUAL ORIENTATION

This is a classic case where superior knowledge prevails. The client, whose name needs to remain confidential pursuant to the terms of the settlement agreement, came to Mr. Semeraro for a consultation, after being denied representation by three prior law firms.

The prior law firms were reluctant to take a case, based upon harassing conduct by a foreman for believing, a heavy equipment operator was homosexual, when in fact, he was not. After documenting a series of harassing statements and conduct, suit was instituted against the employer, a well-known substantial general contracting construction company.

Mr. Semeraro filed a lawsuit against the employer, who maintained a no pay position throughout discovery, but willingly settled after discovery, showed a failure to investigate and mitigate the discriminatory behavior and settled for $375,000.

The salmon enabled the employee to move on with his life and secure alternative employment.
