PREVAILING WAGE SETTLEMENT FOR SKILLED LABOR EMPLOYEES

Mark Semeraro and Scott Fahrney were successful in representing six employees in a Prevailing Wage Claim, Fair Labor Standards Act/New Jersey Wage and Hour Law claim against general contractor for $750,000. Mark and Scott helped to secure a favorable settlement for six different employees working for a contractor who engaged in public entity construction, which required prevailing wages be paid. It was alleged that the contractor underpaid his employees below the prevailing wage standard and failed to pay overtime hours by failing to account for travel time to and from construction sites when the employees loaded the truck at the employer’s contractor’s yard.

While the names of the employees and employer must be kept confidential pursuant to the confidential settlement agreement, the matter was resolved without the need for filing litigation.
