Partners Mark Semeraro and Scott Fahrney have successfully secured a global $2,050,000 settlement on behalf of their client, a non-verbal autistic adult, who was tragically killed while she was walking with her health care aid in a residential neighborhood.
Ms. K (whose identity must remain confidential due to the terms of the settlement agreement), was struck, and run over by a motor vehicle backing out of a driveway. During the accident, Ms. K became trapped and pinned under the vehicle, and ultimately died from her injuries.
Semeraro and Fahrney were instrumental in pursuing both a wrongful death claim for negligent supervision, but also as a products liability claim. The claim was settled globally against three defendants for pain and suffering only as the client was unable to work due to her disability.
